These Terms and Conditions ("Agreement") govern the use of the facilities, services, and any related online or mobile platforms (collectively, the "Services") provided by Wayne Tree Manor ("Wayne Tree Manor," "we," "us," or "our"). By making a reservation or using our Services, you ("User" or "Client") agree to be bound by this Agreement. If you do not agree, please refrain from using our Services.

1. Definitions

User / Client – Any individual or entity that makes a reservation or uses the Services.

Services – The use of Wayne Tree Manor’s facilities (including events, functions, and tours) and any related services offered, whether onsite, online, or via mobile/SMS.

2. Reservation and Booking

Reservation Process – All reservations must be made through our official website, via telephone, or in person. Confirmation is subject to venue availability.

Deposits & Payment – A deposit may be required at the time of booking. Full payment must follow the schedule provided at booking. Failure to pay on schedule may result in cancellation.

Cancellation Policy – Specific cancellation terms and any fees are provided at booking and incorporated herein.

3. Payment Terms

Payments must be made in accordance with the agreed schedule.

User‑initiated cancellations or changes may incur fees set out in the cancellation policy.

4. Collection & Use of Personal Information

Data Collection – We collect personal information, including name, email, and phone number, to confirm reservations, facilitate communication, and comply with applicable regulations.

Consent Framework – Phone numbers and other data are collected only with your explicit consent via separate check‑boxes for (a) Transactional SMS and (b) Marketing SMS (see Section 5).

Compliance – All data handling complies with the Telephone Consumer Protection Act (TCPA), CAN‑SPAM (for email), CTIA guidelines, and other applicable laws.

Data Security & Sharing – Your information is stored securely and is not shared with third parties except as needed to deliver the Services or as required by law.

5. SMS Communications

We offer two distinct categories of text messages. Consent is never a condition of purchase.

5.1 Transactional SMS Notifications

Purpose – Send venue tour confirmations, payment reminders, schedule changes, or urgent operational updates about your event.
Opt‑In Mechanism – Checkbox labeled "I agree to receive SMS updates related to my reservation (Transactional)."
Frequency – Up to 4 msgs/mo (may temporarily increase during active event period).
Opt‑Out – Reply STOP at any time to cease transactional texts. You will receive one final confirmation SMS.

5.2 Marketing SMS Communications

Purpose – Provide invitations to showcases, special offers, or promotional content.
Opt‑In Mechanism – Separate checkbox labeled "I agree to receive promotional SMS messages (Marketing)."
Frequency – No more than 2 msgs/mo.
Opt‑Out – Reply STOP to end marketing texts; confirmation SMS will follow.

5.3 Keywords & Help

STOP / END / CANCEL / UNSUBSCRIBE / QUIT – Cease all messages from the specific category opted‑out.

HELP – Receive a reply with customer‑service contact information: (734) 728‑3020 and [email protected].

5.4 Message & Data Rates

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

6. Use of Services

Users agree to use the Services lawfully and respectfully and follow all posted guidelines and house rules. Users are responsible for any property damage during their event and may incur repair or cleaning fees.

7. Liability & Indemnification

Limitation of Liability – Wayne Tree Manor is not liable for direct, indirect, incidental, consequential, or punitive damages arising from the use of our Services, including unforeseen events or force majeure.

Indemnification – Users agree to indemnify and hold Wayne Tree Manor harmless from any claims arising from the User’s use of the Services or breach of this Agreement.

8. Event Changes & Cancellations by Wayne Tree Manor

We may modify or cancel an event due to circumstances beyond our control (e.g., natural disasters). We will attempt to reschedule or refund where applicable.

9. Governing Law

This Agreement is governed by the laws of the State of Michigan. Disputes shall be resolved in Michigan courts.

10. Amendments

We reserve the right to modify these Terms & Conditions at any time. Changes are effective upon posting on our website. Continued use of our Services constitutes acceptance of the revised terms.
